Working With the Credit Repairing Agencies

Before setting out to know ways of dealing with credit report organizations, it pays understand what SEC. 2451, Title IV of the Consumer Credit Protection Act (Public Law 90-321, 82 Stat. 164) talks about them.

Under section 403 of the above cited act, a credit repairs organization delivers or promises to deliver services such as, for fees or any valuable consideration
* Credit history, report and/or ratings
* Advices or assists consumers (individuals) on the above matters

The list doesn’t include tax exempted non-profit-organizations, any creditor assisting its own customer to the limit of restructuring his/her debt (section 103 of the Truth in Lending Act), depositories, Federal and State credit unions and subsidiaries and affiliates there off.

Deal With Credit Repair Agencies Prudentially
The Credit Repairs Organizations Act prohibits unlawful activities by credit fixing agencies and you can sue them for damages. This is necessitated by the mushrooming of fly by night operators who are just able to set up an office or even just a website.

As a first approach, consult a credit repairs attorney in your district for guidance on how to deal with repairs organizations. Knowing their background, experience and number of years in the business are pointers to their credibility. Secondly, check how long they have been operating from this address. If they moved to this address recently, ask them about the longevity in their previous premise. Many organizations keep changing their offices as an escape tactic.

“A little delay, on your part, in engaging their service will not worsen things for you”

Take time to evaluate their abilities, knowledge and credibility. If you fear that it is a waste of time, evaluate multiple credit repair agencies simultaneously so that comparison could be faster. At no point of time, ie; till you signed the contract, commit anything that might boomerang later.

Discuss how they are going to handle the case, their and your obligations and liabilities incase of willful or chance mistakes. Talk to their past clients personally about their experiences. No genuine credit repair company will hesitate to provide these details to a customer in distress. Once you discussed the details of their plan of action, total fees with breakup, get all these written in the contract paper along with contract cancellation forms.
